Recall of the ASR DePuy Hip Replacement System

After the ASR Hip Replacement system was approved in 2005, problems ensued in 2007 with 100 patients dealing with malfunctions of the ASR system. The number of patients having difficulties with the system doubled in 2008, and in 2009, the number tripled. On August 26, 2010, DePuy Orthopedics, Inc. placed a recall on its ASR Hip Replacement system. A Depuy Hip recall was ultimately issued due to a higher rate of patients requiring a second surgery as a result of loosening detachment of the implant, dislocation of the implant components, and fracture to the bone surrounding the implant.

Significance of DePuy Hip Litigation

Classified as metal-on-metal bearing joint-replacement system, the ASR Hip Replacement system can cause the formation of debris through normal wear. Inflammation and tissue damage occur as a direct result of the debris formation.

In March, a medical device regulation agency, in the UK, issued warnings about the DePuy Hip Replacement system causing debris. Shortly after the warnings, DePuy Orthopedics, Inc. informed physicians of an allegedly higher than average failure rate. Significant orthopedic surgeons issued statements saying “most major medical centers have seen issues with this device.” A 2010 study by the National Joint Registry of England and Wales revealed:

  • 12% of patients utilizing the ASR Hip Resurfacing System needed a second hip replacement (within 5 years of the original).
  • 13% of patients utilizing the ASR XL Acetabular System were in need of a second hip replacement (within 5 years of the original).
  • 1 in 8 hip replacement patients using this implant system will experience total failure, in addition to an even greater number of problems that could require revision surgery.
