Lawyers on both sides of the multi-district litigation (MDL) surrounding DePuy Pinnacle hip implants met in Dallas on August 9, 2011 to begin the process of appointing attorneys to lead the litigation.

The Depuy Pinnacle Hip MDL is a consolidation of over 200 cases brought by plaintiffs who received the company’s Acetabular Cup System implants in their hip replacements and then suffered pain and complications.

According to an order issued by U.S. District Judge Ed Kinkeade, who is overseeing the pretrial proceedings, the lawyers must submit suggestions for conducting the litigation by September 10, 2011. Judge Kinkeade is soliciting suggestions on a range of issues in the case, from structure and pay for lead counsel to scheduling issues and the composition of committees.

System

The DePuy Pinnacle Acetabular Cup System is a metal-on-metal hip replacement implant manufactured by DePuy, a subsidiary of Johnson & Johnson. It works by replacing the entire ball and socket of the hip, both with pieces of metal.

The U.S. Food & Drug Administration issued concerns about the device in February 2011, stating that because metal slides on metal, metal particles may rub off and enter the bloodstream, causing poisoning and other symptoms including pain, swelling and the inability to walk. Sometimes yet another hip replacement becomes necessary.
